1. OUR COMMITMENT TO PERSONAL INFORMATION PROTECTION
Freshfields Bruckhaus Deringer, (the “firm”, “we”, “us”, or “our”) takes its data protection and information security responsibilities very seriously. The effective management of all Personal Information, including its security and confidentiality, lies at the heart of our business and underpins our practices and processes. This is not only conditioned by Data Protection Legislation, but is also driven by our commitment to our clients and to meet their expectations of having in place robust compliance and risk management practices and protocols.
This Privacy Notice (Notice) shall apply solely when we process Personal Information within the scope of the Personal Information Protection Law (PIPL) as amended from time to time. We will only process Personal Information for the purposes described below, where we have a lawful basis to do so under PIPL and where necessary, we will obtain your prior consent.
Where we operate in jurisdictions outside mainland China or where PIPL does not apply, descriptions, and in particular the outlined rights and obligations and limitations to processing contained in this Notice do not necessarily apply, and nothing in this Notice may be interpreted to establish rights or obligations that go beyond what is mandated.
This Notice is in addition to, and does not relieve, remove or replace, our rights and responsibilities under Applicable Laws. In case of a conflict between a provision or requirement of Applicable Laws and a provision of this Notice, the former shall take precedence.
In this Notice, commonly used words and phrases, such as Personal Information and Personal Information Processor, are defined in our Terms and Definitions section.
2. OUR WEBSITE AND ONLINE SERVICES.
In this section, we inform you about the processing of Personal Information in the context of your visit to, and use of, our website. Unless stated otherwise, Freshfields Bruckhaus Deringer LLP generally controls (or jointly controls) the processing of the Personal Information and is the Personal Information Processor in this regard.
2.1 OUR WEBSITE

When visiting our website, your browser will contact our webserver to retrieve the sites you wish to visit. In this context, Personal Information such as your IP address is transferred by your browser (i.e. by HTTP/S requests) to us. This connection information is processed by our webserver to enable access to and the display of our website. Our webserver automatically saves a record of the pages you visited (so-called ‘logfiles’ or ‘session records’). We use these logfiles to ensure the security of our website, in particular to prevent unauthorised interference with it, and to enable us to exercise our legal rights and obligations in regard to such unauthorised interference. Furthermore, we analyse session records to optimise our website. The results cannot be linked to an individual. |

2.2 OUR INFORMATION HUBS, COLLABORATIVE PLATFORMS AND LEGAL TECHNOLOGY

Our information hubs, collaborative platforms, legal technology solutions and other applications (“Solutions”) offer a wide range of resources and alternative ways to deliver our services on a particular Matter, primarily to our clients in the course of our business relationship with them but also to other parties. As a part of our delivery of legal services, we may use AI, where appropriate, including to support with document review, legal research and data analysis. We will process personal information such as names and e-mail addresses to administer and monitor access to (and use of) these Solutions. In order to tailor and further optimise the user experience, the functionalities and operation of these Solutions, and the information provided to you, we may also process personal information regarding your specified preferences, if any, and in some instances information regarding your use of our Solutions. We may also process this personal information for business development purposes and to troubleshoot, develop and improve our Solutions. When you share personal information with us using certain Solutions in relation to a Matter, we will process that information, including Matter Information, for the purposes set out in section 3 of this Notice below. We may also use registration and attendance Personal Information for purposes of business development and, where required by law to do so, to facilitate contact tracing in relation to COVID-19. |

The Freshfields Alumni Network also serves recruiting purposes. The registration form also provides the possibility to subscribe to different newsletters and updates. 8. CROSS BORDER TRANSFERS
In provision of our service supported by Freshfields Entities around the world, we may transfer your Personal Information outside of mainland China internally to other Freshfields Entities. We ensure that any Freshfields Entities that may access your Personal Information, follow the same rules when processing your Personal Information to ensure that your Personal Information is protected.
Many of our third party service providers are located outside of mainland China, so they may transfer your Personal Information outside of mainland China when they process your Personal Information.
We may disclose this information in the following ways: by permitting remote access to Personal Information stored on servers located within mainland China, by direct dissemination (i.e. when you submit information into Freshfields systems including through email, shared link or by telephone) or by sharing this electronically (email, video-conference) or by post.
We may also share your Personal Information directly to other third parties such as to government or judicial authorities where this is required by law or with your prior specific consent.
When we transfer your Personal Information outside of mainland China, we will adopt safeguards under Applicable Laws and regulations before transferring your Personal Information abroad, for instance, to conduct security assessment and obtain government approval if required, as well as other technical and managerial measures to ensure data security during transmission.
9. YOUR RIGHTS
If you are an individual whose Personal Information, and the processing of that Personal Information by the relevant Freshfields Entity is subject to the application of PIPL, you have certain rights. These rights are identified below together with a brief, non-exhaustive explanation. Where your Personal Information and the processing of your Personal Information are not subject to PIPL these rights do not necessarily apply and nothing in this Notice may be interpreted to establish rights or obligations that go beyond what is mandated by PIPL.

EXERCISING YOUR RIGHTS
You may exercise any of your rights by emailing us at dataprivacy@freshfields.com or contacting us by telephone at +44 20 7716 4000. Unless you have arranged otherwise, in the event of your death, a close relative may exercise these rights to your Personal Information.
Before we respond to a communication or request, we may take certain steps to verify the requestor’s identity and the authenticity of a request. Where we have reasonable doubts concerning the identity of the person making the request, or the authenticity of a request, we may request such additional information as we deem necessary to satisfy ourselves of their identity and authenticity of their request.
If we cannot satisfactorily verify the identity of a requestor and the authenticity of a request, we will not be able to take any action pursuant to the request.
In order to facilitate this process and to enable us to assist you, when you make a request to us, please specify the type of request you are making, and provide us with your name, e-mail and telephone number, and satisfactory evidence of your identity. We will use your information only to verify your request by attempting to match your information to our internal records. If you are a client, please also indicate the name(s) of the Freshfields Bruckhaus Deringer attorney(s) with whom you have worked, and we will seek to verify your information with the relevant attorney(s).
You may authorize another person (your “agent”) to submit a request on your behalf. You must provide your agent with a signed and dated permission, stating that your agent is authorized to exercise your rights and to submit a request to Freshfields Bruckhaus Deringer on your behalf. Please note that we may contact you directly to verify the authenticity of the documentation submitted on your behalf.
There is generally no charge for the exercise of your legal rights. However, if your requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may either: (a) charge a reasonable fee taking into account the administrative costs of providing the information or taking the action requested, or (b) refuse to act on the request. We try to respond to all legitimate requests within 15 working days. If your request is particularly complex, or if you have already made multiple requests, it may take us longer than one month to process your request. In this case, we will notify you and keep you updated.
